These terms are an agreement between you and Schooner & The Bear LLC (“we,” “us”) covering your use of the Thanks, Brain iOS application. By downloading or using the app, you agree to them.

License

We grant you a personal, non-exclusive, non-transferable license to use Thanks, Brain on Apple devices you own or control, as permitted by the App Store Terms of Service. The app, its design, artwork, sounds, and code remain the property of Schooner & The Bear LLC.

Not medical advice

Thanks, Brain is not a medical device, does not provide medical or therapeutic advice, and is not a substitute for professional mental health care. It is inspired by ideas from psychology, but it makes no clinical claims and promises no outcomes. If you are struggling, please reach out to a qualified professional — or, in a crisis, to your local emergency or crisis line.

The tip jar

Tips are voluntary consumable in-app purchases. They unlock no features or content, and are processed by Apple under the App Store's payment terms. Refund requests are handled by Apple through their standard process.

Acceptable use

Don't reverse engineer, resell, or redistribute the app, and don't use it in any way that violates applicable law or Apple's terms.

Disclaimer and limitation of liability

Thanks, Brain is provided “as is,” without warranties of any kind, express or implied. To the maximum extent permitted by law, Schooner & The Bear LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us in the twelve months before the claim (which, the app being free, may well be the price of a gumball).

Changes

We may update these terms from time to time. If we do, we will update this page and its effective date. Continuing to use the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules.
